These Terms & Conditions govern the use of SOOPERSELECT.COM and all services provided by Ayn Alhayat Specialized Electric Cars Trading LLC (trading as SOOPERSELECT).

تنظم هذه الشروط والأحكام استخدام موقع SOOPERSELECT.COM وجميع الخدمات المقدمة من شركة عين الحياة لتجارة السيارات الكهربائية المتخصصة ذ.م.م (المعروفة تجارياً باسم SOOPERSELECT).

By accessing our website or using our services, you agree to be legally bound by these Terms in accordance with the applicable laws of the United Arab Emirates.

من خلال دخولك إلى موقعنا أو استخدام خدماتنا، فإنك توافق على الالتزام القانوني بهذه الشروط وفقاً للقوانين المعمول بها في دولة الإمارات العربية المتحدة.

Applicable Laws | القوانين المطبقة

• UAE Federal Decree Law No. 50 of 2022 (Commercial Transactions Law)
• المرسوم بقانون اتحادي رقم 50 لسنة 2022 بشأن المعاملات التجارية
• UAE Federal Decree Law No. 14 of 2023 (Consumer Protection Law)
• المرسوم بقانون اتحادي رقم 14 لسنة 2023 بشأن حماية المستهلك
• UAE Civil Transactions Law (Federal Law No. 5 of 1985, as amended)
• قانون المعاملات المدنية الاتحادي رقم 5 لسنة 1985 وتعديلاته
• Any other applicable UAE federal or local regulations
• وأي تشريعات اتحادية أو محلية أخرى سارية

1. WARRANTY | الضمان

1.1 Nature of Warranty | طبيعة الضمان

SOOPERSELECT provides a limited mechanical warranty on selected vehicles sold directly by the Company, subject to a written agreement.

تقدم SOOPERSELECT ضماناً ميكانيكياً محدوداً على بعض المركبات المباعة مباشرة من قبل الشركة، وذلك بموجب اتفاق خطي.

This warranty is contractual only and does not constitute a manufacturer warranty unless explicitly stated in writing.

هذا الضمان تعاقدي فقط ولا يُعد ضماناً مصنعياً ما لم يُذكر خلاف ذلك خطياً.

1.2 Coverage | نطاق التغطية

Warranty coverage is strictly limited to:

تقتصر التغطية على ما يلي فقط:

• Internal mechanical failure of engine components
• الأعطال الميكانيكية الداخلية لمكونات المحرك
• Internal mechanical failure of transmission components
• الأعطال الميكانيكية الداخلية لناقل الحركة
• Structural integrity of chassis (excluding misuse or accident damage)
• السلامة الهيكلية للشاصي (باستثناء الأضرار الناتجة عن الحوادث أو سوء الاستخدام)

1.3 Exclusions | الاستثناءات

The warranty does not cover:

لا يشمل الضمان ما يلي:

• Electrical and electronic systems (ECU, sensors, wiring, modules)
• الأنظمة الكهربائية والإلكترونية
• AC and cooling system components
• نظام التكييف ومكونات التبريد
• Suspension and braking systems
• أنظمة التعليق والفرامل
• Wear and tear items (belts, filters, spark plugs, fluids)
• القطع الاستهلاكية
• Oil leaks due to aging or maintenance neglect
• تسرب الزيوت الناتج عن التقادم أو الإهمال
• Damage from misuse, racing, or off-road abuse
• الأضرار الناتجة عن سوء الاستخدام أو السباقات
• Unauthorized modifications
• التعديلات غير المعتمدة
• Consequential or indirect damages
• الأضرار غير المباشرة أو التبعية

1.4 Limitation of Liability | تحديد المسؤولية

Company liability is limited strictly to repair or replacement of covered components.

تقتصر مسؤولية الشركة على إصلاح أو استبدال الأجزاء المشمولة فقط.

No compensation shall be payable for loss of use or business interruption.

لا يحق المطالبة بأي تعويض عن تعطيل الاستخدام أو خسارة الأعمال.

Warranty becomes void if repairs are conducted without prior written approval.

يُلغى الضمان في حال إجراء إصلاحات دون موافقة خطية مسبقة.

Nothing herein limits mandatory consumer rights under UAE law.

لا يؤثر ما ورد أعلاه على الحقوق الإلزامية للمستهلك وفق قانون الدولة.

2. BOOK INSPECTION (PPI) | حجز فحص

2.1 Scope of Service | نطاق الخدمة

Inspection is conducted on visible and accessible components only, without dismantling.

يتم الفحص على الأجزاء الظاهرة والمتاحة فقط دون فك أو تفكيك.

The report reflects professional opinion only and is not a performance guarantee.

يمثل التقرير رأياً فنياً فقط ولا يُعد ضماناً لأداء المركبة مستقبلاً.

2.2 Limitation of Liability | تحديد المسؤولية

SOOPERSELECT shall not be liable for hidden defects not discoverable at inspection time.

لا تتحمل SOOPERSELECT مسؤولية العيوب الخفية غير القابلة للاكتشاف وقت الفحص.

Maximum liability shall not exceed the inspection fee paid.

الحد الأقصى للمسؤولية لا يتجاوز رسوم الفحص المدفوعة.

3. BUY A CAR | شراء سيارة

3.1 Sale Basis | أساس البيع

Vehicles are sold:

تباع المركبات:

• As inspected
• حسب الفحص
• As disclosed
• حسب الإفصاح
• Subject to written agreement
• بموجب عقد بيع خطي

Unless stated otherwise, vehicles are sold on an “as-is” basis.

ما لم يُذكر خلاف ذلك، تباع المركبات على أساس “كما هي”.

3.2 Buyer Responsibility

Buyer is responsible for:

• Conducting independent inspection
• إجراء فحص مستقل إن رغب
• Insurance and registration transfer
• التأمين ونقل الملكية
• Any fines or Salik after transfer
• المخالفات أو رسوم سالك بعد نقل الملكية

4. SELL A CAR | بيع سيارة للشركة

Seller warrants lawful ownership and full disclosure of finance or accident history.

يقر البائع بملكيته القانونية للمركبة والإفصاح الكامل عن أي تمويل أو حوادث سابقة.

Failure to disclose material defects may result in legal action under UAE law.

عدم الإفصاح عن العيوب الجوهرية قد يؤدي إلى اتخاذ إجراءات قانونية.

5. LIST YOUR CAR (AED 699 PACKAGE) | اعرض سيارتك (باقة 699 درهم)

SOOPERSELECT provides marketing and listing services only.

تقدم SOOPERSELECT خدمة تسويق وإعلان فقط.

The Company does not guarantee sale timeframe or price.

لا تضمن الشركة مدة البيع أو السعر النهائي.

Service fee is non-refundable once report and listing are completed.

رسوم الخدمة غير قابلة للاسترداد بعد إتمام الفحص والإعلان.

6. GOVERNING LAW & JURISDICTION | القانون والاختصاص القضائي

These Terms are governed by the laws of the United Arab Emirates.

تخضع هذه الشروط لقوانين دولة الإمارات العربية المتحدة.

Any dispute shall be subject to the competent courts of the Emirate in which Ayn Alhayat Specialized Electric Cars Trading LLC is registered.

يختص بنظر أي نزاع المحاكم المختصة في الإمارة المسجلة بها شركة عين الحياة لتجارة السيارات الكهربائية المتخصصة ذ.م.م.
